Commission Terms of Service


By ordering a commission from me, "CaptainWoolyWolf", "Wooly" ("the Artist"), you ("the Client") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/cancelled commission with or without a refund, and/or a blacklist. Please note that these Terms of Service may be subject to change without prior notice.

These Terms of Service are in effect as of JANUARY 20, 2023.

Will Draw

The Artist is willing to draw any of the following:

  1. Clean, G-rated art
  2. Any animal characters or creatures, including "anthro" (two-legged) or "feral" (four-legged in most cases)
  3. Pets
  4. Humans/humanoids
  5. Text-based character descriptions
  6. Plush or robotic/animatronic characters

Section 1.2 - Will Not Draw

The Artist will not draw any of the following:

  1. Explicit sexual content (pornography)
  2. Suggestive sexual content or fetish/kink artwork
  3. Nudity
  4. Explicit violence or gore
  5. Anything depicting pedophilic, incestuous and/or zoophilic relations
  6. Any explicit or implicit use of recreational drugs, including cannibis, or related paraphernalia
  7. Political or sensitive themes
  8. Depictions of demonic/satanic themes, characters, or symbols, as well as witchcraft/sorcery.
  9. Certain fandom characters/styles

Section 2 - General

  1. The Artist has a right to refuse the commission for whatever reason, with or without explanation.
  2. The Artist has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  3. The Client has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  4. The Artist has a right to upload the commission on any/all social media, and/or for promotional use, unless specified by the Client beforehand to keep the commission private.
  5. Payment is to be made after the Client has approved the sketch. The sketch will be resized and watermarked. The commission will be on an "on hold" status until payment has been received.
  6. The Artist will not work with deadlines or rush orders.
  7. The Artist does not work on a "first come first serve" basis. Smaller commissions / commissions that do not take much time may be worked on in between larger commissions / commissions requiring more time.
  8. The Client may contact the Artist at any time to ask for a progress check on the commission, but no more than once every week. The Client is encouraged to contact the Artist via social media (Cara, SheezyArt, Toyhouse) if the Client is unable to reach the Artist via email/Discord.
  9. The Client is NOT to send the Artist any reference images or text descriptions that include explicit content, including but not limited to: pornographic content, graphic violence/gore. If the Client does not possess a reference that does not contain such content, the Client is expected to properly and fully censor such content before providing it to the Artist. Sending explicit content to the Artist will result in rejection of the commission, and the Client will be blacklisted from further commissioning the Artist.
  10. Due to Paypal's Terms of Use, the Client must be 18 years of age or older to commission the Artist.

Section 3 - Image Rights

  1. The Client may make minor edits to the completed commission (eg. Cropping, Adding text/borders, Changing Brightness/Contrast/Hue/Saturation...).
  2. The Client may not make major edits to the completed commission (eg. colouring or drawing over) without prior permission. The Client may NOT make edits with the intent to deface or vandalize the commission.
  3. The Client may use/reupload the commission for personal/non-commercial use, but only if proper credit to the Artist (CaptainWoolyWolf) and a linkback to any of the Artist's social media (Cara, SheezyArt, Toyhouse) is provided.
    1. If the commission includes characters that do not belong the Client, additional credit to the owner(s)/creator(s) of said characters must be provided when using/reuploading for personal/non-commercial use.
  4. The Client may not use the commission for any commercial use unless discussed with the Artist beforehand.
    1. Commissions for commercial use will be charged more than personal/non-commercial commissions. Prices are negoatiable.
    2. If the commission includes characters that do not belong the Client, the Client can not use the commission for commercial use unless explicitly written permission from the owner(s)/creator(s) of said characters is provided.
  5. The Client may not claim the commission as the Client's own work, whether the Client did or did not make any edits to the commission. If any edits were made by the Client, the Client should state them upon uploading or sharing the edited commission.
  6. The Artist does not claim ownership to any of the characters/subjects portrayed in the commission. Characters belong to their respective creator(s)/owner(s).

Section 4 - Delivery/Turnaround

  1. All commissions will be processed and delivered digitally, regardless of commission type ("digital" or "traditional").
    1. The Client will not receive any physical copies of the commission.
    2. The Client is paying for a service / digital good and will not require any shipping of any kind.
    3. No shipping address is required by the Artist from the Client.
  2. All commissions will be done as sampled in the style ordered.
  3. All commissions will be done in the format specified under the commission type/style, unless specified otherwise. Exceptions may be made, depending on the commission.
  4. The Client may ask for a specific canvas size / dimensions for the commission.
    1. Digital commissions with a canvas size larger than 3000px may have an additional charge.
    2. Digital commissions with a canvas size smaller than 1000px may have prices negotiable. (Note: Smaller canvas sizes may result in losses to detail/ and or quality).
    3. "Traditional" commissions will always be done at the same scale, therefore dimensions (or resolution) will not affect charge.
  5. All commissions will be sent via email with the completed commission .PNG/.JPG/.GIF (dependent on commission type) file attached.
  6. Unless specified not to upload the commission to the public, any commissions may be posted on the Artist's social media, resized and watermarked.
    1. Commissions may be posted on the Artist's social media, resized and watermarked, after the Client has received and approved the original unmarked commission file.
    2. The Client may choose to remain anonymous when the Artist publicly uploads the commission.
  7. Depending on the desired style and queue, the estimated turnaround is about one (1) week to two (2) months at the latest.
    1. If the Artist has to take longer than two (2) months to complete the commission for whatever reason, the Client will be contacted and informed of the status of the Client's commission.

Section 5 - Payment

  1. Payment is to be made after the Client has approved the sketch. The Client is not to send payment upfront.
  2. Payment is to be made via PayPal only.
  3. PayPal payment is to be done in USD (United States Dollars).
  4. PayPal payment is to be done using invoices. The Artist will require the Client's PayPal email.
  5. The Client does not need to pay extra for any of the PayPal fees.
  6. Payment must be sent within 72 hours after confirmation.

Section 6 - Refunds

  1. If the Client cancels the Client's commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been completed:
    1. 65% refunded if in the lineart stage
    2. 50% refunded if in the base colours stage
    3. 30% - 20% refunded if in the shading stage / final touches
    4. The Client will not receive any files of the commission.
  2. If the Artist cancels the commission for whatever reason, the Client will receive a full refund, in addition to a .PNG (or equivalent extension based on the commission type) file of whatever progress of the commission has been completed.
  3. Refunds will be given within 72 hours after correspondence.
  4. The Client will not be refunded if the Client is unsatisfied with a completed commission.
    1. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (eg. adjusting colours), up to a maximum of two (2) times after correspondence. Any desired major revisions (eg. reposing, colour scheme change, etc.) will be rejected.
    2. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form / correspondence while the commission was still in the sketching/lineart stage (eg. missing marking or tattoo that's essential to the character's design).
  5. Issuing a chargeback on the Artist at any time when the Client and the Artist have had direct communication with each other in the last 14 days, can and will result in the Client being blacklisted from further commissioning the Artist, and a public service announcement being made to protect other Artists.
    1. Chargebacks are only acceptable when the Artist has failed to provide the Client with a completed commission within the given turnaround time (up to 60 days since payment sent, or if otherwise discussed), and/or the Artist fails to directly contact the Client or provide updates to the Client on the commission's progress after a 14 day time period.

Section 7 - Commission Process

The following is a sample of the Artist's commission process:

  1. The Client orders via a form on the Artist's website, https://captainwoolywolf.neocities.org/commissions . An email is required for the Artist to get in contact with the Client. The Client's email will remain private and will not be shared.
  2. The Artist contacts the Client via email within 72 hours after the Client has sent the order form, confirming the acceptance or rejection of the commission. Upon acceptance, the final price and details of the commission is confirmed.
  3. The Client will receive an uncoloured, rough sketch (resized and watermarked) of the commission. Any major revisions (eg. pose, expression) must be done at this stage.
  4. The Client approves the sketch. Payment is to be made (via PayPal Invoice) within 72 hours.
  5. Upon confirmation that the payment has been received, the Artist will begin work on the commission.
  6. During the commission process, the Artist will keep the client up to date of the commission's progress at important stages. Eg. in a digital commission, the artist will send a preview of the finished coloured stage. At these stages, any and all revisions should be made. Upon approval, the Artist will continue to work on and finalize the commission. The frequency of these updates will depend on the commission type and intricacy of the particular commission.
  7. Upon completion of the commission, the Client will receive the commission file via email. Only minor changes (eg. brightness, colour adjustments, etc.) can be made at this point. Any and all major revisions (eg. reposing, colour scheme change, etc.) will be rejected.
  8. If permitted, the Artist may post a resized and watermarked version of the commission on social media.
